Texas Intoxication Manslaughter Case To Go To Jury

The Dallas Intoxication Manslaughter case of Ex Dallas Cowboy Player Josh Brent is going to go to the jury this Tuesday. Both sides rested and closed evidence Friday afternoon and arguments will begin Tuesday morning.

This past week the prosecutors presented evidence that Brent had a blood alcohol level of .18 and failed field sobriety test at the scene of the accident. The defense counter with their own expert who testified that the crime lab did not follow their own procedures and made mistakes while testing.

During closing arguments the prosecutors will argue Brent’s failure to pass field sobriety test and the.18 blood test will satisfy the burden of proof. The defense will argue that the police recording of Brent do not show a person who speaks like an intoxicated person and any mistakes made during testing are due to the results of surviving a car accident.
