No Refusal for Holidays

The holiday season is upon us once again which means lots of office parties and celebrations. The holiday season also means that law enforcement agencies in the Dallas- Ft. Worth area will increase “No Refusal” policies on all DWI arrest. Law enforcement officials will have extra officers and Judges available to execute blood draw search warrants on any DWI arrest in which a suspect refuses to submit to a breath or alcohol test by the police.

In the case of a blood draw search warrant  a criminal defense attorney should always closely review the police officers affidavit for the search warrant. If there is a problem with the probable cause affidavit a judge may suppress the search if the facts show the was not sufficient facts to warrant probable cause.
